Tomando en cuenta que el concepto del voto universal no existia, la votación era por legislaturas del estado, es decir el congreso del estado decia con quien.
Al momento de no aceptar la derrota Guerrero y Lovato organizan un motin en la carcel de la acordada (Hilton Alameda). Se van al zocalo a hacer desmadre. Saquean el mercado del Parian y al palacio nacional, diciendo “Viva Lovato y lo que arrebato”.
Guerrero al fin logra subir al poder gracias a la presión ejercida a Guadalupe Victoria. El legitimo ganador, Gómez Pedraza se fue al exilio.
