La Suprema Corte de Justicia de la Nación (SCJN) determinó este martes que si la policía recibe una denuncia y está investigando delitos, puede inspeccionar a una persona o un vehículo sin una orden judicial.
Pero, ¿qué implica esto?
Para evitar confusiones, la Corte explicó en qué casos se puede hacer esta revisión y en cuáles representa una ilegalidad. Aquí te los explicamos:
El policía sólo puede inspeccionar a personas o vehículos si hay una investigación criminal abierta, es decir, como parte de la indagatoria para dar con el o los responsables de un delito.La Corte detalla que la inspección en caso de flagrancia sólo se puede realizar si hay "sospecha razonable" de que la persona coincide con las características del sujeto denunciado como probable responsable del delito cometido.Los agentes de policía pueden inspeccionar a personas o vehículos cuando el delito ya fue cometido y hay una investigación en curso por parte de la policía y el Ministerio Público.Si un policía observa hechos o circunstancias que hagan suponer que se está cometiendo un delito en un vehículo, podrá proceder a revisarlo.

The Supreme Court of Justice of the Nation (SCJN) determined this Tuesday that if the police receive a complaint and are investigating crimes, they can inspect a person or a vehicle without a court order.
But what does this imply?
To avoid confusion, the Court explained in which cases this review can be carried out and in which it represents an illegality. Here we explain them:
The police can only inspect people or vehicles if there is an open criminal investigation, that is, as part of the investigation to find the person or persons responsible for a crime.The Court details that the inspection in case of flagrante delicto can only be carried out if there is "reasonable suspicion" that the person matches the characteristics of the subject reported as likely responsible for the crime committed. Police officers may inspect people or vehicles when the crime has already been committed and there is an ongoing investigation by the police and the Public Ministry. If a police officer observes facts or circumstances that suggest that a crime is being committed in a vehicle, he may proceed to review it.
